SOFTWARE LICENSE AND USAGE AGREEMENT

This Software and its associated documentation (collectively, the "Software") 
are proprietary products protected by copyright, trade secret, and other 
intellectual property laws. By downloading, installing, accessing, or using 
this Software, you ("User") agree to be bound by the terms of this Agreement.

1. GRANT OF LICENSE

Subject to strict compliance with all terms herein, Michael Doube grants 
you a limited, non-exclusive, non-transferable, non-sublicensable, revocable 
license to:

  • Install and use the Software on a single device for personal or internal 
    business purposes.
  • Distribute unmodified copies of the Software to third parties, provided 
    that such distribution includes this entire Agreement and all copyright 
    notices intact.

2. STRICTLY PROHIBITED ACTIVITIES
--------------------------------------------------------------------------------

The User expressly agrees NOT to engage in any of the following activities:

  2.1 Reverse Engineering & Decompilation
      Reverse engineer, decompile, disassemble, or attempt to derive the source 
      code, underlying algorithms, logic, or structure of the Software. This 
      includes using any tools or techniques to bypass compiled code protections.

  2.2 Modification & Derivative Works
      Modify, adapt, translate, patch, or create derivative works based upon 
      the Software. Any alteration of the binary or executable code is strictly 
      forbidden.

  2.3 Circumvention of Payment Mechanisms
      Circumvent, disable, bypass, or interfere with any license verification, 
      payment processing, usage tracking, or security mechanisms embedded in 
      the Software. This includes, but is not limited to:
      - Cracking activation codes or license keys.
      - Patching binaries to remove payment checks.
      - Using "cracked" or "patched" versions of the Software.
      - Intercepting or manipulating network traffic to falsify usage data.

  2.4 Unauthorized Distribution
      Distribute modified versions, "cracks," "patches," or tools designed to 
      circumvent the Software's security or payment requirements.

3. LEGAL CONSEQUENCES AND APPLICABLE STATUTES

Violation of this Agreement constitutes not only a breach of contract but may 
also constitute criminal offences under the laws of multiple jurisdictions. 
The User acknowledges that circumventing payment mechanisms to obtain software 
value without payment may be prosecuted as theft, fraud, or computer misuse.

  3.1 United Kingdom
      • Fraud Act 2006 (Section 6): Obtaining services dishonestly with the 
        intent to avoid payment.
      • Computer Misuse Act 1990 (Sections 1, 2, and 3): Unauthorised access 
        to computer material and unauthorised acts with intent to impair 
        computer operation.
      • Copyright, Designs and Patents Act 1988 (Section 296ZA): Circumvention 
        of technological protection measures.

  3.2 Switzerland
      • Federal Act on Copyright and Neighbouring Rights (URG/Loi sur le droit 
        d'auteur, LDA): Protection against circumvention of effective 
        technological measures (Art. 39a).
      • Swiss Criminal Code (StGB/CP): Provisions regarding fraud (Art. 146) 
        and computer fraud (Art. 147).

  3.3 European Union
      • Directive 2009/24/EC (Software Directive): Legal protection of computer 
        programs, specifically prohibiting decompilation except under narrow 
        exceptions.
      • Directive 2001/29/EC (InfoSoc Directive): Anti-circumvention provisions.

  3.4 United States of America
      • Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 1201: Prohibition 
        on circumventing technological measures controlling access to works.
      • Computer Fraud and Abuse Act (CFAA), 18 U.S.C. § 1030: Unauthorised 
        access to protected computers.
      • Wire Fraud Statute, 18 U.S.C. § 1343: Fraud involving electronic 
        communications.

  3.5 International Treaties
      • WIPO Copyright Treaty (WCT): Obligations regarding technological 
        protection measures.

4. NATURE OF VIOLATIONS
--------------------------------------------------------------------------------

The User acknowledges that:
  • Circumventing payment mechanisms to use the Software without paying is 
    considered obtaining a service dishonestly (UK Fraud Act 2006) and may 
    constitute fraud or computer misuse.
  • Decompilation and reverse engineering for the purpose of bypassing 
    payment controls are strictly prohibited and may carry criminal penalties.
  • "Theft" in the digital context may be prosecuted under specific statutes 
    (e.g., Computer Misuse Act) even if no physical property is removed.

5. INTELLECTUAL PROPERTY OWNERSHIP
--------------------------------------------------------------------------------

All rights, title, and interest in and to the Software, including all 
intellectual property rights, remain the exclusive property of Michael Doube.
No license is granted except as explicitly stated in Section 1.

6. DISCLAIMER OF WARRANTIES
--------------------------------------------------------------------------------

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR 
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS 
FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. LIMITATION OF LIABILITY
--------------------------------------------------------------------------------

IN NO EVENT SHALL Michael Doube BE LIABLE FOR ANY DIRECT, INDIRECT, 
INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR 
INABILITY TO USE THE SOFTWARE.

8. TERMINATION
--------------------------------------------------------------------------------

This License is effective until terminated. Your rights under this License will 
terminate automatically without notice if you fail to comply with any term 
hereof. Upon termination, you must cease all use of the Software and destroy 
all copies, full or partial, of the Software.

9. GOVERNING LAW AND JURISDICTION
--------------------------------------------------------------------------------

This Agreement shall be governed by and construed in accordance with the laws 
of Switzerland. Any disputes arising from this Agreement shall be subject to 
the exclusive jurisdiction of the courts of Vaud, Switzerland. 
However, the User acknowledges that criminal proceedings may be initiated in 
any jurisdiction where the offence (e.g., fraud, computer misuse) occurs.
